Welcome to Storybook Season. These Terms of Service (the "Terms") are a binding agreement between you and Pathlyte LLC ("Pathlyte," "we," "us," or "our") governing your use of the Storybook Season mobile application, website, and related content and services (together, the "Service").
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please note: Section 12 contains an arbitration agreement and class action waiver that affect your legal rights.
The Service is designed for parents and guardians. You must be at least 18 years old (or the age of majority where you live) to create an account. Accounts belong to adults; child profiles within an account exist only to personalize the experience and are created and controlled by the account holder.
Storybook Season provides original bedtime stories — audio and video retellings of historic college football games — along with sleep music, timers, and related features. The stories are creative, gentle retellings crafted for young listeners. While inspired by real events, they are storytelling, not journalism or an educational reference, and we make no representation as to historical completeness or accuracy.
We may add, change, or remove content and features at any time. We do not guarantee that any particular story, feature, or piece of content will remain available.
You are responsible for your account, for maintaining the security of your sign-in method, and for all activity under your account. Keep your information accurate. We may suspend or terminate accounts that violate these Terms or that we reasonably believe harm the Service or other users.
The Service and everything in it — stories, scripts, narration, artwork, music, video, software, and branding — are owned by Pathlyte or its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for private, non-commercial use in your household.
You may not copy, record, redistribute, publicly perform, sell, scrape, data-mine, reverse engineer, or create derivative works from the Service or its content, or use any content to train machine-learning models, except as expressly permitted by us in writing or by law.
Storybook Season is not affiliated with, sponsored by, or endorsed by any university, athletic conference, or sports organization. Team and institution names may be referenced in a historical, descriptive context only.
You may provide limited information such as child first names or nicknames, age ranges, and team preferences. You grant us a worldwide, royalty-free license to use that information to operate, personalize, and improve the Service. See our Privacy Policy for how we handle it.
You agree not to misuse the Service, including by: circumventing payment or access controls; sharing account credentials beyond your household; interfering with the Service's operation or security; using the Service in any unlawful way; or accessing the Service by automated means.
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 5 and 9–13) survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT WILL ACHIEVE ANY PARTICULAR RESULT (INCLUDING SLEEP OUTCOMES).
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) PATHLYTE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL; AND (B) PATHLYTE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY DOLLARS ($50) OR THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Pathlyte and its officers, members, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
Please read this section carefully — it affects your rights.
You and Pathlyte agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be conducted remotely or, if an in-person hearing is required, in the county where you live.
Class action waiver. Disputes will be resolved only on an individual basis. You and Pathlyte each waive the right to participate in a class action, class arbitration, or representative proceeding, and the right to a jury trial.
Opt-out. You may opt out of this arbitration agreement by emailing support@storybookseason.com within 30 days of first accepting these Terms, with your name and the email on your account.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Pathlyte regarding the Service.
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in the app or by email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
